SRINAGAR: A court in Srinagar has declined to grant interim relief seeking deferment of the Annual General Meeting (AGM) of the Jammu and Kashmir Cricket Association (JKCA) scheduled to be held in Jammu on September 27.
The order was passed by 2nd Additional District Judge Srinagar, Naushad Ahmad Khan, on Saturday while hearing an application filed under Section 151 of the Code of Civil Procedure seeking postponement of the AGM notified by JKCA on September 6.
The application was moved in a pending civil suit filed by Javed Ahmad Kitab, who has claimed to be the elected president of the association. The suit relates to disputes over his alleged suspension, the constitution and functioning of the Apex Council and the appointment of an Ombudsman.
In his order, the court declined to restrain the AGM from being held. The judge observed that the applicants had not established the requirements necessary for grant of an interim injunction, including a prima facie case, balance of convenience and the likelihood of irreparable injury.
The court also considered objections challenging the AGM notice and alleging non-compliance with provisions of the JKCA Constitution.
However, the judge clarified that dismissal of the interim application should not be construed as a final determination on the legality or validity of the AGM notice.
The court said issues relating to compliance with the JKCA Constitution, the authority to issue the notice, circulation of required documents and the validity of any resolutions passed at the AGM would be examined in appropriate proceedings.
With the interim plea rejected, there is no court order restraining the JKCA AGM scheduled for September 27.
