ACB files charge-sheet against 10 in Batamallo illegal construction case
Srinagar, Aug 17: The Jammu and Kashmir Anti-Corruption Bureau (ACB) has filed a charge-sheet against 10 accused persons, including seven officials of the Srinagar Municipal Corporation (SMC) and three private individuals, in connection with an alleged illegal construction case in Batamallo area of Srinagar.
According to the ACB, the charge-sheet was filed before the Court of Special Judge, Anti-Corruption, Srinagar, in FIR No. 06/2023 registered at Police Station ACB Srinagar under provisions of the J&K Prevention of Corruption Act, Ranbir Penal Code (RPC), the J&K State Lands (Vesting of Ownership to the Occupants) Act, and the Evacuees (Administration of Property) Act.
The case pertains to alleged illegal and unauthorised construction near Tiny Hearts School in Tengpora, falling under Ward No. 28 of Batamallo.
The ACB said the case was registered following allegations that officials of the Srinagar Municipal Corporation had allegedly abused their official position and entered into a criminal conspiracy with a private beneficiary, identified as Reyaz Ahmad Dar of Tengpora, Batamallo, facilitating or allowing the construction in violation of applicable laws and regulations.
According to the bureau, the investigation, based on oral and documentary evidence, found material supporting the allegations against the accused public servants and private individuals.
After obtaining the required sanction for prosecution of the public servants from the government, the ACB presented the charge-sheet before the Special Judge, Anti-Corruption, Srinagar, for judicial proceedings.
The allegations and findings of the investigation will now be subject to examination by the court during the trial process.
