19 JKCA-affiliated clubs oppose SGM notice, seek its withdrawal

JAMMU: Nineteen affiliated clubs of the Jammu and Kashmir Cricket Association (JKCA) have opposed the notice issued for a Special General Meeting (SGM), alleging that it violates the association’s constitution and existing court orders.

In a joint representation submitted to the JKCA authorities, the clubs demanded the immediate withdrawal of the notice issued on July 11 and said they would neither recognise nor participate in the proposed meeting. They also appealed to other affiliated clubs and life members to stay away from the meeting.

The clubs alleged that the notice had been issued by the Honorary Secretary despite his suspension by the Special General Meeting held on June 27, claiming that a suspended office-bearer had no authority under the JKCA Constitution to convene meetings or issue official communications. They further alleged that the mandatory concurrence of the JKCA President, as required under the association’s constitution, had not been obtained.

The representation also claimed that the notice violated an interim order passed by the Additional District Judge, Srinagar, in a civil suit on June 6, alleging that the order remained in force.

Questioning the procedure adopted, the clubs said the JKCA Constitution requires 21 clear days’ notice for a Special General Meeting or, in emergent circumstances, at least 48 hours’ notice along with reasons for urgency. They alleged that the notice, issued less than 24 hours before the proposed meeting, did not meet these requirements.

The clubs further contended that several agenda items proposed for the meeting had already been discussed and resolved during the June 27 Special General Meeting and therefore could not be reopened without any change in circumstances.

They also questioned the authority of the present Apex Council to convene the meeting, alleging that its composition was under challenge before the Additional District Judge, Srinagar.

The representation further called for an end to what it described as the intervention of a former BCCI-appointed sub-committee member in the affairs of the association. It also alleged that the proposed meeting was being convened in haste to facilitate the appointment of a former cricketer to a key position in the JKCA and raised allegations relating to his previous association with the body.

The clubs urged the JKCA authorities to withdraw the notice, refrain from implementing any decisions taken at the proposed meeting and adhere to the provisions of the association’s constitution and judicial orders. They also said they reserved the right to seek appropriate legal remedies if the notice was not withdrawn.
