Srinagar: The Lieutenant Governor of the Union Territory government of Jammu and Kashmir has affected several amendments in the Jammu and Kashmir Civil Service (Judicial) Recruitment Rules, 1967 notified on January 04, 1968.
The amendments were made by the LG in exercise of the powers conferred by Article 234 of the Constitution of India in consultation with the High Court of Jammu and Kashmir and Ladakh and the Jammu and Kashmir Public Service Commission, stated an SO notified by the Department of Law, Justice and Parliamentary Affairs.
Among others, syllabus has been changed for the civil service examinations which shall henceforth comprise General Knowledge, Indian Constitutional Law, The Bharatiya Nagarik Suraksha Sanhita, 2023, The Bharatiya Sakshya Adhiniyam, 2023, The Bharatiya Nyaya Sanhita, 2023, and The Limitation Act, 1963.
Similarly, its paper-B shall comprise of a. General Financial Rules, 2017, The Jammu and Kashmir Service Regulation, 1956 (Chapters III to XIII and XXII and XXIII), Rules and Orders for the Guidance of Subordinate Courts (Civil and Criminal) and Circular Orders issued by the High Court, The Code of Civil Procedure, 1908, The Registration Act, 1908, The Transfer of Property Act, 1882, and The Jammu and Kashmir Residential and Commercial Tenancy Act, 2012.
Also for rule 12, the written (main) examination shall include compulsory and optional papers and every candidate shall take all the compulsory papers and three out of the optional papers.
The Compulsory Papers include Paper I English Essay, b) Translation from English into Urdu or Hindi and vice versa, c) Precise.
Paper II shall comprise General Knowledge, Indian Constitutional Law. Similarly Paper III will be on: a) The Bharatiya Nagarik Suraksha Sanhita, 2023, b) The Bharatiya Sakshya Adhiniyam, 2023, c) The Bharatiya Nyaya Sanhita, 2023.
Paper IV will be based on subjects like a) General Financial Rules, 2017; b) The Jammu and Kashmir Service Regulation, 1956 (Chapters III to XIII and XXII and XXIII); c) Rules and Orders for the Guidance of Subordinate Courts (Civil and Criminal) and Circular Orders issued by the High Court.
The paper V will be about the code of civil procedure 1908, The limitation Act 1963 and the Registration Act of 1908.
Likewise the paper VI will include The Transfer of Property Act 1882, and The J&K Residency and Commercial Tenancy Act 2012.
According to the SO the optional subjects will consist of Hindu Law, Mohammadan Law for paper I and Law of Companies and Insurance Law for paper II. Principles of equity including the Law of Trusts and specific relief will be put as paper III in optional and Indian Contract Act 1872 and Law of Torts will be offered as paper IV in optional subjects.
The SO states that paper V as optional will include Suits Valuation Act 1887, Court Fee Act 1870, The Indian Stamp Act 1899 and Excise Act and Rules.
The paper VI shall comprise Land Revenue Act, The Right to Fair Compensation and Transparency in Land Compensation, Rehabilitation and Resettlement Act 2013.
