Srinagar, Jan 18: The J&K High Court today directed the government to dispose off within two months the matter relating to payment of compensation to Jamiat-e-Ahlehadees for land acquired from it by the government for construction of a Court complex at Moominabad in city outskirts.
Justice Sanjeev Kumar disposed of the writ petition filed by Jamiat-e-Ahlehadees, directing that if any request with regard to payment of compensation is pending consideration before the Divisional Commissioner, “the same shall be considered on its merits and disposed of within two months from the date a copy of this order is made available in the office of the Commissioner.”
“Keeping in view the submission of learned counsel for the petitioner and the nature of relief prayed for, the writ petition is accordingly disposed of,” he ordered.
The petitioner shall be at liberty to deliver a copy of this order along with the copy of the writ petition in the office of the Divisional Commissioner Kashmir, the order said.
The Jamiat-e-Ahlehadees had filed the writ petition seeking direction to respondents to settle the claim of the organization for payment of compensation on account of expenditure incurred by it for development of the land situated at Moominabad, Batamaloo, as promised by the government.
It sought that the respondent government officers be directed to pay the amount of compensation to the petitioner organization within the shortest period of time so that it could complete the pending projects which it has initiated for development of educational institutions in the state.
The petitioner organization said that the land which has been utilized for construction of District Court Complex at Moominabad, was in its possession and was taken over by the government.
The then regime had extended a promise to the petitioner organization that they would be adequately compensated and passed an order No.40-Rev/S of 2008 dated 18.02.2008 in this effect, it told the court.
The petitioner said that that it approached the respondents including the Divisional Commissioner, Kashmir, to fulfill the promise but nothing was done in this regard.
The counsel for the petitioner submitted that the petitioner would feel satisfied, if the writ petition is disposed off at this stage, by directing the Divisional Commissioner Kashmir, to take a quick decision on the pending request of the petitioner organization.
