Navin Choudhary reviews status of court cases under Special Provisions Act

JAMMU, NOVEMBER 13: Principal Secretary Finance, Navin K Choudhary today chaired a meeting to review the status of court cases under Jammu and Kashmir Civil Services (Special Provisions) Act-2010. The Act provides for regularization of employees appointed on Adhoc, contractual and consolidated basis.

Secretary Rural Development & Panchayati Raj, Sheetal Nanda, Secretary Law, Justice & Parliamentary Affairs, Abdul Majid Bhat, Director General Accounts & Treasuries, M Y Pandith,Director General Finance (Codes),Mohammad Rafiq Andrabi, Additional Secretary, General Administration Department, Subash C Chhibber and other concerned officers were present at the meeting.

Navin Choudhary, who is also the Chairman of the Empowered Committee on regularization under Special Provisions Act, called for regular follow-up of the court cases to ensure speedy disposal.

He called for promptly responding to all litigations and ensuring that the prolonged pendency of such cases does not result in delaying the regularization of the deserving.

The meeting was informed that the prerequisites which are to be ensured as per the Act for regularization include; appointment against clear vacancy and post in a government department, the employee must be continuing to work without any break, employee must possess all requisite qualification and eligibility for the post on the date of his initial appointment on adhoc or contractual or consolidated basis as prescribed under the relevant recruitment rules governing the service of post and that no disciplinary or criminal proceedings should be pending against the appointee.

The Empowered Committee constituted by virtue of the Jammu and Kashmir Civil Services (Special provisions) Act has the mandate to scrutinize the cases of contractual, Adhoc and Consolidated employees and make appropriate recommendation for their regularization on case-to-case basis.
