SRINAGAR: The Jammu and Kashmir Government has dismissed a government school teacher from service and disqualified him from future government employment after invoking Article 311(2)(b) of the Constitution in connection with a criminal case registered under provisions of the POCSO Act and the Bharatiya Nyaya Sanhita (BNS).
According to an order issued by the School Education Department, Khalid Hussain, a Teacher Grade-II posted at Government Middle School Bumalpora, Gurinalla, in Kishtwar district, has been removed from service with immediate effect.
The order, issued by Commissioner/Secretary School Education Ram Niwas Sharma, states that the action was taken after considering the facts and circumstances of the case, including FIR No. 34/2026 registered at Police Station Chatroo under various provisions of the BNS and the Protection of Children from Sexual Offences (POCSO) Act.
The government said the teacher, who was already under suspension and is presently in judicial custody, was found liable for a major penalty on the basis of material placed before the competent authority.
Invoking sub-clause (b) of the proviso to Article 311(2) of the Constitution, read with Rule 30(viii) of the J&K Civil Services (Classification, Control and Appeal) Rules, 1956, the government imposed the penalty of dismissal from service, which ordinarily disqualifies an employee from future government employment.
The order states that the government was satisfied that it was not reasonably practicable to hold a regular departmental inquiry in the case and that the circumstances warranted immediate action.
In a separate statement, the School Education Department said the decision was taken after determining that conducting a departmental inquiry was not feasible under the circumstances. It added that the government remains committed to ensuring the safety and protection of children in schools and maintaining accountability among educational staff.
The department said the criminal investigation and trial in the case are being pursued by the concerned law enforcement authorities in accordance with the law.
