Court directs JKBOSE to allow 22 students of pvt school to sit in class 10 exams

Srinagar: A Srinagar court on Saturday directed the Chairman J&K Board of School Education (JKBOSE) and joint secretary to allow 22 students of The Islamic Global School, Padshahibagh Srinagar to appear in class 10th exams.

The directions were issued as the authorities at JKBOSE earlier denied class 10th exam registration forms to the students despite the government directions, forcing the school management to approach the judiciary for relief.

As per the order issued by the court of Civil Judge Senior Division (CJM), the Chairman JKBOSE and Joint Secretary General were directed to allow the students to appear in the class 10th exam.

“A peculiar situation has come before the court which warrants passing appropriate orders in the matter as simply adjourning the matter can have an effect of ruining the career of students,” the court order reads.

“Accordingly, counsel for the defendants are directed to submit their written statement on the next date of hearing and in the meantime, defendant 3 and 4 (Chairman JKBOSE and Joint Director General) are directed to accept the registration renewal and examination forms of 22 students and allow them to appear in the examination of 10th class in all subjects/papers for the current session 2024-25 conducted by the defendants,” it reads.

The court observed that the students whose career is involved and have not been issued admit cards were present in the courtroom along with their parents and have shown a sense of urgency before the court and prayed that appropriate orders aimed at directing the concerned for issuance of admit cards be passed in the matter.

As per the court order, the plaintiff in the open court has shown the forms attested by Principal Government Boys Higher Secondary School (BHSS) Natipora indicating the satisfaction of Principal Government BHSS Boys also that the said students are equipped with necessary qualifications to appear in 10th class examination.

“Counsel for the defendant 1, 2 and 5 (Commissioner Secretary School Education Department, CEO Srinagar and Joint Director (EE) Directorate of School Eeducation Kashmir) is not averse to the relief prayed by the plaintiff and submitted that since the Chief Education Officer in terms of communication dated 22.01.2025 and the Principal Government BHSS Natipora have requested for registration renewal of 22 students of class 10th, as such in order to save the academic career of the students,” the court observed.

It said that Chairman JKBOSE and Joint Secretary General were directed to permit the 22 students of plaintiff to sit in examination of 10th class for the session 2024-25 which is scheduled to be held from February 17, 2025.

The court observed that the Chief Education Officer Srinagar has requested for registration of 22 in itself presupposes that the said 22 students have pre-requisites to appear for the 10th class.

“This order is conveyed accordingly to defendants for compliance,” the order reads.

A copy of the order has been sent to the Joint Secretary (General) JKBOSE Bemina for compliance.

As already reported, DSEK had in December 2024 issued orders to tag the students of class 9th and 10th enrolled in The Islamic Global School Padshahibagh Srinagar, with the nearby government school for the current 2024-25 academic session “in order to save the academic career of the students.”

Following this, the office of the Chief Education Officer (CEO) Srinagar in an official communication to Secretary JKBOSE conveys that the 22 class 10th students of The Islamic Global School Padshahibagh Srinagar have been tagged with Boys Higher Secondary School Natipora for the current session.

As per the communication the decision was taken in compliance with the directions received from DSEK.

“In view of the above, as a special case and to save the academic career of the students it is requested that the 22 students be registered with JKBOSE and their examination forms for class 10th be accepted through BHSS Natipora, on priority,” the official communication reads.

The Principal BHSS Natipora Srinagar in an official communication also informed the JKBOSE Chairman that the students of The Islamic Global School Padshahibagh Srinagar were tagged with their institute and requested the Board authorities them to “consider the case of the students and facilitate the Registration Renewal and examination form.”

However, despite the clear instructions from the DSEK and the information conveyed from the CEO office Srinagar, the JKBOSE did not allow the students to appear in the class 10th annual Board exams scheduled from February 17 of this year.
