Srinagar: A Sessions Court here on Wednesday awarded ten-year imprisonment and a fine of Rs 25,000 to a man for raping a minor girl in 2012. 

Second Additional Sessions Judge Srinagar, Renu Dogra Gupta sentenced Irshad Ahmad Malik, son of Habib Ullah Malik of Ahlan Gadwak Kokernag, Anantnag, to 10-year imprisonment and a fine of Rs 25,000. Malik had been held guilty of the commission of the offense punishable under section 376 IPC in terms of a judgment passed on the 29th of May.

The guilty man, a married man at the time of the commission of the crime, pleaded that he was the sole breadwinner of his family. He prayed for mercy. 

The government lawyer contested the mercy petition and sought for life imprisonment of the convict saying “the convict had shown no mercy on the 14-year-old girl and had impregnated her”.   

The judge held that the court is of the considered opinion that 10-year imprisonment of the convict and a penalty of Rs 25,000 is an adequate punishment in the case. 

The convict at the time of committing the heinous crime of rape with the minor girl was a married person. He was living with his wife in a rented room in the neighborhood of the victim. 

“The accused had gagged her mouth and committed the heinous and barbaric crime of rape with her. He had also threatened her to not disclose the same to anyone,” the court had said and convicted him for the offense under 376 RPC (rape).
