Court defers hearing as counsel cites ‘security’ reason

Srinagar: Sessions court Srinagar Tuesday deferred till May 23 hearing in criminal revision petition against former militant Farooq Ahmad Dar alias Bitta Karate in connection with Kashmiri Pandit Satish Tickoo’s murder case after counsel for the petitioner moved an application for adjournment citing ‘security’ reasons.

The counsel for the petitioner moved an application before 1st Additional District and Sessions Court Srinagar seeking adjournment of hearing alleging that the police despite Apex Court directions could not provide security to him. The Session Court listed the matter for the next hearing on May 23

Pertinently Advocate Utsav Bains appearing on behalf of Tickoo’s family (petitioner) had sought a detailed status report on all first information reports (FIRs) registered against Farooq Ahmad Dar alias Bitta Karate.

Bains in his adjournment application said that he flew back to Delhi from Srinagar Airport as police had not made any security arrangements for him.

“It is requested to your lordship to please adjourn today’s hearing in Criminal Revision No 138 of 2022 in the interest of justice. No security was provided to Advocate Utsav Bains by Jammu & Kashmir Police today in spite of orders by Hon’ble Supreme Court of India, the learned advocate has to unfortunately, return back to Delhi after landing at the Srinagar Airport today at 9 am,” reads the application.

Maharaj Kishan Tickoo, Brother of Satish Tickoo through his counsel in his plea has submitted that his brother was shot at and critically injured at his residence by Dar and his accomplice (co-accused) on February 2, 1990. He submitted that the injured was shifted to SMHS hospital where doctors declared him as brought dead.

The court had on April 16 listed a Criminal Revision Petition challenging the order passed by a Magistrate court on September 1 last year whereby the application seeking direction to complete the investigation with regard to the killing of Satish Tickoo in February 1990 and filing of the charge-sheet was dismissed in default.
