HC directs show cause notice against lady officer who obstructed a Judicial Magistrate from performing his duties

Srinagar March 14: The High Court has taken a strong note of use of “dirty language” and “obstructing” the duty of a Judicial Magistrate by a J&K Tourism Department Officer on Tuesday at Nishat Road near the city’s Royal Golf Course.

The court directed a show cause notice against the lady officer seeking an explanation as to why action in terms of applicable laws for obstructing a Judicial Magistrate from performing his duties is not taken against the officer.

The court passed the direction for notice after examining a complaint by the Special Mobile Magistrate (Traffic) Srinagar stating that while he was holding his Mobile Court at Nishat Road near Royal Golf Course on March 10, one lady officer from the Tourism Department caused unnecessary obstruction and used filthy language against him.

The Magistrate sought initiation of contempt proceedings against the lady officer.

“The perusal of the report of the Registrar Judicial accompanied with the communiqué of the Special Mobile Magistrate Srinagar reveals that the Magistrate has literally been manhandled”, observed the court.

It said “the language used against the Magistrate is deplorable”. However, before proceeding further, the court directed the Magistrate to file his affidavit.

“Registry shall issue a notice at the official address of the lady named in the report of the Magistrate after ascertaining her particulars from the Commissioner Secretary, Tourism Department”, the court directed.

It also directed the lady officer to show cause as to why she shall not be proceeded against in terms of applicable laws for obstructing a judicial Magistrate from performing his duties.
