Srinagar, Aug 15: Court of Special Mobile Magistrate on Tuesday rejected the bail plea of a person allegedly involved in the kidnapping of a minor girl.

The accused — Mohammad Ibrahim Bhat, son of Irshad Ahmad Bhat of Haba Kadal Zaindar Mohalla Srinagar was arrested by Police Station Zakura on July 19, 2018 in a case (FIR no. 47/2018) under section 363 RPC.

Counsel for the accused had submitted that the victim was a consenting party and urged that if she had accompanied the accused out of her own will, no question of her kidnapping could arise at all. He urged that accused is innocent and has not committed any offence and authorizing his further detention will curtail his liberty.

But prosecution argued that the victim is a minor and the accused is not entitled for any leniency as he is involved in the commission of an offence of kidnapping of a minor girl of tender age.

He also urged that if the accused is admitted to bail he will certainly hamper the investigation and tamper with the prosecution witnesses.

As per police, on July 19, 2018, a written report was lodged by a Khimbrani Hazratbal resident that his 16-years-old daughter went from her home towards Hazratbal for buying some household things but did not return back home.

On this report, a case was registered vide FIR No. 47/2018, and during investigation the girl and the boy were apprehended while they were heading towards Batpora, police says.

The court rejected the bail to the accused in view the nature of accusation, nature of evidence , and interest of the society at large.
