    HC orders payment of minimum wages to casual labourers in J&K

    Srinagar: The J&K & Ladakh High Court has held that Section 12 of the Minimum Wages Act casts a legally enforceable duty upon the employer to pay every employee wages at a rate not less than the minimum wages fixed.

    The judgment was passed in a writ petition filed by scores of need-based casual labourers engaged by the government in different departments since 2014.

    The petitioners pleaded that they were being paid rupees 100 per day, which is against the mandate of the Minimum Wages Act

    Justice Sanja Dhar, while passing his judgment on the petition, recorded that since the minimum wages have been fixed by the Government of J&K in terms of Government Orders dated 25.01.2018 and 23.04.2022, as such the respondents cannot deny the benefit of the same to the petitioners.

    “Doing so would be a violation of Section 12 of the Minimum Wages Act, which is impermissible in law”, Justice Dhar said.

    He directed the respondent authorities “to pay wages to the petitioners at the rate of Rs 225/- per day from 1st January, 2018 up to 31st March, 2022 and at the rate of Rs 300/- per day from 5 01.04.20222 onwards for the days they have actually worked with the respondents. The petitioners shall also be entitled to arrears of the wages for the aforesaid period”.

    The respondents have been directed to calculate and disburse the wages, including the arrears, at the aforesaid rates and for the aforesaid period to the petitioners, within a period of three months. Failing compliance, the arrears of wages shall carry interest @6% per annum till their realisation.

    The petitioners sought a direction upon the respondents to release the wages in their favour @ Rs 300/- per day from 01.04.2022 in light of Government Order No.121-F of 2022 dated 23.04.2022.

    A further direction to release the wages in favour of the petitioners @ Rs 225/- per day w.e.f 01.01.2018 in terms of Government Order No.27-F of 2018 dated 25.01.2018 and @ Rs 150/- per day with effect from the year 2014 along with all consequential benefits, has also been sought.

    The petitioners further submitted that the Government has enhanced wages to daily wagers from Rs 225/- to Rs 300/- per day w.e.f 01.04.2022 in terms of Government Order No.121-F of 2022 dated the Wages Act. 23.04.2022, but the petitioners are still being paid wages @ Rs.100/- per day, which is against the mandate of Minimum

    The government authorities contested the writ petition, saying that the petitioners are neither working as daily wagers nor are they in receipt of Rs 225/- per day as wages. It has been further submitted that Government Order No.121-F of 2022, dated 23.04.2022, is applicable only to the duly engaged daily wagers, including casual labourers.

    They said that the petitioners are working on a need basis in the respondent departments and not as daily wagers/casual labourers; as such, the Government Order dated 23.04.2022 is not applicable to them.

    The court, after examining the records, found that the petitioners have been engaged as casual labourers on a need basis at the minimum wages permissible under the rules.

    “The engagement orders of petitioners are identical in nature, and the said orders specifically provide that the petitioners have been engaged on a need basis on the minimum wages applicable under the rules. Thus, contention of the respondents that the petitioners were engaged on consolidated wages is not borne out from the record,” noted the court.

    It said there is no justification for the respondents to deny the wages to the petitioners at the rates and for the period mentioned in the aforesaid two Government orders.

    Jammu: A woman was arrested for allegedly being involved in the killing of her husband and dumping his body in a bag in Udhampur’s Chenani area, police said on Sunday.

    Besides her, police have arrested a woman and her son for playing a role in the killing.

    The matter came to light with the discovery of a bag, lying under stones and emitting a foul smell in the Laddha village on Thursday, a police spokesperson said.

    When it was checked, police found a male body in it in a decomposed state.

    The man was later identified as Ravi Kumar, a resident of Chulna-Panchari.

    Investigation led police to suspect Nisha Devi, Kumar’s wife, her sister-in-law Kanta Devi, and her son Joginder of Nargela village to be the key figures behind the murder.

    The three were taken into custody, where they confessed to their involvement in the killing due to a “personal domestic dispute,” police said.

    Srinagar: Peoples Democratic Party (PDP) president Mehbooba Mufti on Sunday reviewed the opposition party’s organisational status and challenges faced by the people of Jammu and Kashmir.

    “Party President Mehbooba Mufti chaired a key meeting with senior leaders, contesting candidates and district presidents to assess the party’s organisational position and review challenges being faced by people on the ground across various fronts,” PDP said in an X post.

    The meeting was attended by top party leaders including Abdul Rehman Veeri Ghulam Nabi Lone, Mehboob Beg and Abdul Haq Khan.

    Srinagar: Chief Minister Omar Abdullah has called a meeting of his cabinet colleagues and top officials of both the civil and Police administration on May 28.

    A Meeting Notice issued by the General Administration Department said that the meeting will be held at the famed tourist resort of Gulmarg at 12 pm.

    Besides the Deputy Chief Minister and other ministers, the Chief Secretary, all Administrative Secretaries, the Divisional Commissioner, Kashmir, the Inspector General of Police, Kashmir, and Directors of different departments, including Tourism and Information are to attend the meeting, official sources said.

    Samba: An Assistant Sub-inspector (ASI) was killed and another cop injured when a speedy vehicle hit them in Samba district early Sunday, officials said.

    ASI Yog Raj Singh along with his team had set up a checking point on the border road at Pulpur in Supwal area following information about possible attempts by smugglers to transport bovine animals, they said.

    The officials said that the police party tried to stop a speedy mini load-carrier at around 4.15 am, but its driver jumped the barricades and hit them, resulting in injuries to the ASI and another policeman.

    The injured were rushed to a nearby hospital where the ASI succumbed to his injuries, they said.

    The officials said that the police have registered a case and recovered the vehicle, which was found abandoned in a nearby area, while a hunt is on to identify and arrest the culprit.

    Jammu/Srinagar: Two alleged drug peddlers, including a resident of Punjab, were arrested along with 1.2 kg charas here, an official of the Anti-Narcotics Task Force (ANTF) said on Sunday.

    Akshay Dogra of Jammu’s Bohri area and Arun Manhas of Punjab’s Pathankot were moving in a private vehicle when they were intercepted by a team of ANTF, Jammu and Kashmir Police, near Parmandal Morh late Saturday, leading to the recovery of the narcotic substance, he said.

    The official said that both the accused were arrested and booked under various sections of the Narcotic Drugs and Psychotropic Substances (NDPS) Act for further investigation to expose their backward and forward links.

    The ANTF appealed to the general public to come forward regarding any information related to drugs so that this menace could be uprooted completely from the society and the young generation could be saved from it, he added.

    Police in Baramulla also arrested a drug peddler — Abid Rasheed Sofi, son of Abdul Rasheed Sofi, resident of Heewan Baramulla — at Zandfaran after 190 grams of a cannabis-like substance was recovered from his possession.

    Jammu: An alleged notorious criminal was detained under the stringent Public Safety Act (PSA) in the Kathua district of Jammu and Kashmir, police said on Sunday.

    Suraj Masih, a resident of Haria Chak Marheen, has been booked under the PSA after obtaining a formal detention order from the district magistrate, a police spokesman said.

    He said multiple cases are registered against the accused who has been lodged in the Udhampur district jail.

    The spokesman said his alleged repeated criminal activities posed a serious threat to peace in the area, prompting police to prepare his dossier for the PSA, which allows detention without charge or trial up to two years in some cases. (PTI)

    J&K shines at Khelo India Beach Games 2025 with stellar 9-medal tally

    SRINAGAR: Jammu and Kashmir exhibited remarkably outstanding performance at the Khelo India Beach Games 2025, clinching a total of 9 medals, including 5 gold, 1 silver and 3 bronze, besides earning widespread praise from dignitaries and sports enthusiasts.

    Union Minister of Youth Affairs and Sports, Dr. Mansukh Mandaviya, congratulated the J&K contingent for their outstanding dedication towards nurturing sporting talent and a culture of excellence during the vibrant closing ceremony held at the INS Khukri Memorial in Diu.

    Union Minister of State for Sports and Youth Affairs, Raksha Nikhil Khadse, hailed the Games as a landmark event, stating, “Our young athletes have truly lit up the shores of Diu with their brilliance, ushering in a new era for Indian sports.”

    Jammu and Kashmir’s athletes made a strong impact across the disciplines. The team emerged as overall champion in the men’s pencak silat category and secured third place in the women’s category, contributing significantly to J&K’s impressive 4th place finish among 30 States and Union Territories, one of the region’s best performances at a national multi-sport event.

    The Games, hosted at Ghoghla Beach in Diu, featured over 1,350 athletes competing in six medal sports including beach soccer, volleyball, sepaktakraw, kabaddi, pencak silat, and open water swimming, alongside demonstration events such as mallakhamb and tug-of-war.

    J&K’s gold medal winners were Saaliq Farooq, Adeeba Gulzar, Muskan Shaban, Sajad Beigh and Tawzeeh Mujeeb. Silver was secured by Jibran Masood while Ravees Ahmad, Ruqaya Manzoor and Sarfaraz Ali took home bronze medals.

    The J&K beach volleyball team also showcased exceptional skill, defeating hosts Dadra and Nagar Haveli and Daman and Diu, as well as Chhattisgarh, in their matches.

    The J&K contingent was led by Divisional Sports Officer and their participation was sponsored by the J&K Sports Council.

    Minister for Youth Services and Sports, J&K, Satish Sharma, congratulated the athletes and their coaches for their exemplary performance. He reiterated the government’s commitment towards transforming Jammu and Kashmir into a centre of sporting excellence. “Ongoing improvements in sports infrastructure and regular coaching camps are key to our athletes’ success on national stages,” he said.

    Secretary, Youth Services and Sports, J&K, Sarmad Hafeez, extended his congratulations to the team for their spirited performance and expressed gratitude to Union Minister Dr. Mansukh Mandaviya for his encouragement and continuous support in strengthening sports in the region.

    Secretary J&K Sports Council, Nuzhat Gul, also applauded the athletes and coaches, affirming that Jammu and Kashmir is progressing steadily on the path of sporting excellence.

    SRINAGAR: Deputy Chief Minister, Surinder Choudhary, today visited Gurudwara Chatti Padshahi at Rainawari, Srinagar and paid obeisance there.

    The District Gurudwara Parbandhak Committee Srinagar, led by its President, Jaspal Singh, apprised the Dy CM of various issues. They demanded a declaration of holiday on 12th of June instead of 5 July on the occasion of Parkash Utsav of 6th Guru Guru Hargobind Sahib ji as per calendar Nanak Shahi Samvat 557 issued by Shrimoni Gurudwara Parbandhak Committee (Amritsar).

    They also demanded a declaration of a gazetted holiday on 30th May, which is a restricted holiday on the occasion of the Martyrdom of Guru Arjan Dev Ji.

    While interacting with the members of the delegation, the Dy CM reiterated that the government is committed to providing all the necessary support to the community to realise their dreams and aspirations.

    The Dy CM assured the DGPC that he would discuss the issues with the concerned authorities for redress at the earliest.

    While paying obeisance, the Dy CM prayed for peace, progress and prosperity of people of Jammu and Kashmir.

    Srinagar District admin spreads awareness on growing menace of drug abuse

    SRINAGAR: District Administration Srinagar today organised an awareness programme on Drug De-Addiction at Boys Higher Secondary School Palpora aimed at sensitising the masses about the harmful effects of drug abuse and encouraging them to eradicate the menace of drugs from the society.

    The event was held on the directions of Deputy Commissioner (DC) Srinagar Dr. Bilal Mohi-Ud-Din Bhat, as a part of an ongoing Drug Free Jammu and Kashmir initiative of the Government to educate students, staff members, and local residents about the growing menace of drug addiction and the collective responsibility to curb it.

    During the event, informative sessions addressing the physical, mental, and social consequences of substance abuse were held to effectively sensitise the participants.

    On the occasion, the Artists from the Cultural Unit Kashmir, Department of Information and Public Relations (DIPR), presented a powerful and thought-provoking short play to raise awareness about the growing menace of drug abuse.

    The resource persons representing Social Welfare, Police, Health, Education, Excise and SMC, others emphasised the crucial role of education, awareness, and community involvement in eradicating the menace of drugs from society.

    The students also contributed through speeches, skits, and discussions emphasizing the message of Drugs Free Kashmir.

    The awareness program witnessed active participation from students, local community members, and staff of the School.
