  High Court stays suspension order of Executive Officer MC Sopore

Sopore, June 01: The Jammu and Kashmir High court has stayed the suspension order of Executive Officer Municipal Committee (MC) Sopore.

A court order issued on Friday evening, a copy of which lies with Kashmir Images, reads that Abdul Lateef Mir Executive officer Municipal committee Sopore through his advocate M.A Beigh filed a petition at High Court Srinagar to challenge his suspension order issued by Urban Local bodies last month.

“Mr Beigh learned counsel has invited the attention of this court to the order passed on 08-05-2019 WP (C) 1952/2019 in terms whereof this court while recording prima facie satisfaction that the Director, Urban Local Bodies, Kashmir, has no power/competence to place the petitioner under suspension stayed the order qua the petitioner with the further observation that mere pendency of the writ petition or the order passed by the court shall not form any impediment for the competent authority to take action against the petitioner as warranted under rules,” reads the order.

“Respondent competent authority instead of proceeding in the matter, has confirmed action of the Director Local Urban Bodies, which stand not to be in tune with the judgment passed in the case titled Ghulam Mohammad Qazi and others versus Managing Director J&K TD Corporation and others reported in SLI 1989 J&K (295),”  it reads.

According to order, the next hearing of the case is listed on 3rd May.

On 9th May 2019, the Urban Local Bodies issued an order vide no 126-HUD-2019 which reads, “On the basis of report submitted by the investigative team after they found mismanagement / grave lapses committed by Shri Abdul Lateef Mir, I/C Executive Officer, Municipal Committee Sopore is placed under suspension vide order no DULB/PS/601 of 2019 dated 01/05/2019 and was attached with the Executive Engineer Town Drainage Division, Kashmir with immediate effect.”
