Irfan Hafeez Lone demands restoration of pre-1953 position in J&K

Srinagar, March 4: Irfan Hafeez Lone, a civil society activist and legal expert Monday demanded restoration of pre-1953 position in Jammu and Kashmir under the light of section 147 of Article 370 of Indian constitution.

Addressing media at Kashmir Press Club, Lone said the relation of Jammu and Kashmir with Union of India is governed by Instrument of Accession (IoA) which also gives rights to the state constituent assembly to revoke or amend any order under the light of section 147 of Indian constitution.

He appealed all the political parties including NC, PDP and PC to bring a resolution in the upcoming session of the assembly after elections to revoke all amendments made in the “taxonomy”.

He said there are many amendments made in the state constitution ever since Jammu and Kashmir acceded with the Union of India.

“The state constituent Assembly has powers to revoke any amendment made in the constitution by invoking section 147 of the Article 370 and there is no need to consult or approach New Delhi for this purpose,” said Lone.

He said the accession with India is based on Article 370 and incase its abrogation or any amendment in the laid down act, the accession automatically come to end.

“Since the relation between Jammu and Kashmir is governed by Instrument of Accession, our state constituent assembly have powers to do away with any amendments made so far under the light of section 147,” he added.

He said the accession with India was a temporary agreement, however the amendments in the constitution made from time to time speaks a lot about the intensions.

Lone said it is the collective responsibility of all regional political parties to exploit the benefits of section 147 extended to the state constituent assembly under the Article 370.
