Batamallo murder case: Court directs prosecution to produce witness

Srinagar: Court of Additional Session judge Srinagar on Monday directed prosecution to produce witness in support of the allegation levelled against accused under section 302, 201 RPC in Police station Batamallo.

Both the accused namely Muneer Aziz War and Izhar-ul-Islam were arrested by police on 18. 05.2012. The sequence of events as revealed in the prosecution case is that a missing report of Wali Mohammad Hajam alias Imtiyaz S/o Ghulam Rasool R/o Wagat Handwara (a mason by profession) who was putting up in Batamaloo Srinagar was filed by his cousin on 15.05.2012.

Subsequently police search parties were dispatched to all parts of the state to trace the missing. During the course of investigation 25 people who had in some way remained in close association with the deceased were questioned.

Finally the investigation team zeroed in on two persons Muneer Ahmed War S/o Abdul Aziz R/o Hatmula Kupwara at present staying in Batamaloo and Izhar-ul-Islam S/o Abdul Majeed Ganie R/o Hassanpora Bijbehara Anantnag, at present staying in Batamaloo, wherein it was revealed that the victim has been murdered and his body dumped at a partially earth filled plot of land in Lane No. 5 Firdosabad Batamallo.

As per the report, the main accused Muneer Ahmed War was harboring grudge against the deceased on account of his close proximity with a girl to whom the accused was strongly attracted to and purportedly had a relation with her.

The second accused Izhar-ul-Islam who was called by the main accused to his house facilitated the disposal of the corpse. On sustained questioning the main accused identified the site where he dumped the dead body and also the modus operandi of the murder as well as the preparation made by him in this regard.

Subsequently the weapon of offence a sharp edged 16 inch knife was also recovered on the basis of the identification made by the accused. During the course of investigation it came into limelight that the accused and the victim were well acquainted with each other as they lived in the same locality.

On that fateful day the victim had visited the house of the accused where again they had a duel about their relation with the girl. The accused did not like the proximity of the victim with the girl. The victim was frequently visiting the house of the girl to which the accused strongly objected to for obvious reasons.

The accused also having a relation with the same girl wanted to get rid of Wali Mohammad Hajam.

Accordingly the accused who was waiting for an opportunity and had already procured a sharp edged knife from a local blacksmith from Rainawari gave a couple of blows to the victim on his head with this sharp weapon thereby causing his death.

The counsel for accused, Advocate Mohd Abdullah Pandith pleaded before the court that prosecution be directed to produce the witnesses in the case on the next hearing.

The next date of hearing is on September 6.
