Srinagar, Aug 20: Court of Chief Judicial Magistrate Srinagar has directed Police Station Soura to register an FIR in Umar Qayoom killing case of 2010 summer unrest.

Chief Judicial Magistrate Srinagar, Ajaz Ahmad Khan while pronouncing the order in open court on Monday, asked the State that a special investigation team (SIT) should be constituted after registration of FIR against persons responsible for the killing of a teenaged boy of Soura.

Court further directed that, an investigation be conducted by Divisional Commissioner to look into the circumstances as to why FIR wasn’t registered in 2010 itself, and why proceedings under section 176 CrPC (inquest proceedings) have not been completed and submitted to the corned authority.

The court asked the Divisional Commissioner Kashmir to file report within a month.

It said the SIT is to be headed by SSP Srinagar, who shall monitor the said investigation as directed in previous orders passed in the case.

SHO Police Station Soura has been directed to provide all the assistance to SIT, and Divisional Commissioner in their investigations.

As per the victim’s family, Umar Qayoom, a Class 11 student from Soura area of Srinagar, was picked up by police from outside his home. He died after two days in police custody on August 25, 2010.

Since past eight years, the family of the deceased teenager has been exploring every option to get the FIR registered in the case.

An application was filed by the father of the deceased says that on 20th Aug 2010, his son (Umar Qayoom) was arrested by cops of Police Station Soura and was beaten mercilessly, resulting in damage to his internal organs which finally led to his death.

He said the police station concerned released the son on 21/8/2010 who subsequently died on 25/8/2010.

Besides repeated requests, police station concerned did not register an FIR which constrained the applicant to approach this court.

The concerned SHO submitted report that the son of the applicant along with two other persons were apprehended by police station concerned and taken under preventive measures under section 107 and 151 Cr.PC. They were accordingly produced before the Ex. Magistrate 1st Class, North on 21/8/2010.

“The said three persons were released on bail bonds by the corned Magistrate who handed over them to their legal heirs after complying all legal formalities.”
