Srinagar: The Judicial Magistrate Tangmarg today slapped one year jail term and Rs 12 lakh in penalty on a person for issuing a cheque that bounced for insufficient funds in his account.
The court of Judicial Magistrate 1st Class, Towfeel Ahmad Mir, convicted Mushtaq Ahmad, Dar son of Ghulam Rasool Dar, resident of Nagbal Kreeri Pattan, Baramulla, under section 138 of Negotiable Instruments Act.
The accused had issued cheque to the complainant Gulzar Ahmad Rather, son of Ghulam Ahmad Rather of Kawarhama of Baramulla in lieu of the purchase of a vehicle at an agreed cost of Rs six lakhs.
The cheque No.729981, issued on July 10, 2022 payable from his account No. 0075040100002598 in J&K Bank B/U Chandoosa Baramulla, however, bounded for lack of sufficient funds in the account.
The complainant through his lawyer, Ashiq Ahmad Magray approached the court.
He pleaded “the accused has intentionally and deliberately issued the cheque knowing that there are not sufficient funds in the account to honor the said cheque, as such accused has intentionally cheated and defrauded the complainant.”
