HC seeks and J&K admin pledges to furnish Sagar’s detention records by May 10

Srinagar : The J&K administration on Monday gave an undertaking to High Court for furnishing the detention records of incarcerated senior National Conference (NC) leader Ali Mohammad Sagar by the 10th of this month.

Hearing a writ petition by the detained leader, the court had in an earlier direction asked the government to file a counter-affidavit in the case besides producing the detention records of the petitioner.

Sagar, the NC general secretary, is one of the scores of political leaders and activists detained by the authorities after the abrogation of Jammu and Kashmir’s special status under Article 370 on 5th of August 2019.

After failing for two consecutive hearings to produce the detention records of Sagar before the court, B A Dar, the senior additional advocate general of J&K today undertook to produce the records before the court by the 10th of the current month.

He told the court that a counter-affidavit into the case has been filed with a copy provided to counsel for the petitioner.

Justice Sindhu Sharma, who heard the matter, listed it for consideration on the date specified by the additional advocate general.

Sagar, the five times elected lawmaker for the J&K State Assembly, was detained initially for six months under Criminal Procedure Code and later on kept in custody under the Public Safety Act (PSA).

The petition filed by Sagar through his counsel said that the detenue was suffering from multiple ailments and was susceptible to COVID-19 infection due to his frail health and old age.

J&K High Court had on May 04 this year asked the government to consider release of Sagar on health grounds raised in his plea.

It had also sought a report from the government on the matter.
