DLSA Sgr team visits Central Jail, identifies under-trial prisoners eligible for release under Section 479 of BNSS

SRINAGAR: In a move to uphold the rights of under trial prisoners, the District Legal Services Authority (DLSA) Srinagar today took a proactive step to ensure compliance with the order dated 22/10/2024, passed by the Honorable Supreme Court in WP(C) No. 406/2013, titled “Re: Inhuman Conditions in 1382 Prisons and Implementation of the Provisions of Section 479 BNSS by Prison Authorities.”

The compliance of the order was ensured by the Legal Aid Defense Counsels, of DLSA Srinagar, who visited the Central Jail Srinagar under the guidance of Jaffer Hussain Beg, Chairman DLSA/ Principal District and Sessions Judge Srinagar, and the supervision of Nusrat Ali Hakak, Sub-Judge/Secretary DLSA Srinagar.

The Supreme Court’s order focuses on improving prison conditions and the implementation of Section 479 BNSS Act by state prison authorities. This section is crucial for providing relief to under trial prisoners and facilitating the timely release of deserving individuals.

During the visit, legal aid defense counsels meticulously identified under trial prisoners who might be eligible for release under Section 479 of the BNSS. This process involved careful examination of individual cases, considering factors like the severity of the offence, length of detention, and likelihood of securing bail.

DLSA Srinagar is committed to working in collaboration with the prison authorities to ensure that all under trial prisoners are treated fairly and have access to the legal aid and resources they need. This visit is a testament to their dedication to upholding the principles of justice and human rights within the prison system.
