Srinagar: J&K High Court on Wednesday reserved its judgment on a plea by a father seeking direction for exhumation of the body of his son killed in an encounter in November 2021 at Hyderpora, Srinagar.

The bench of Chief Justice Pankaj Mithal and Justice Javed Iqbal Wani heard and reserved their verdict on exhuming the body of Aamir Magray son of Mohammad Latief Magrey of Doda Jammu.

The High Court on Monday had been directed by the Supreme Court to consider within a week the plea of Mohammad Latief Magrey. The petitioner prayed for a direction to exhume the body of his son. He also sought to permit the family to conduct their son’s last religious rites at the graveyard where he had been discreetly buried last year by the J&K Police after encounter.

Mohammad Latief Magrey on 24th of June had challenged in the Apex Court a J&K High Court division bench judgment that stayed its own single bench direction calling for exhumation of the body of Aamir and taking the remains to his ancestral graveyard.

The division bench of the High Court on 3rd of June had allowed an appeal by the Home Department of the government seeking nullification of the single bench relief to the father of the deceased.

The Apex Court had also requested the High Court to consider the plea for the grant of compensation to Mohammad Latief Magrey for the death of his son Aamir Magrey.
