Srinagar: The High Court Tuesday directed the additional advocate general of J&K government to ensure that Mushtaq Ahmed Peer, former BOPEE chairman, is produced before the Medical Board for examination.

In terms of order passed by the High Court on 25th of the previous month the Principal Government Medical College, Srinagar was asked to constitute a medical Board for facilitating the medical examination of the convict and furnishing of the report.

The communication has been sent by the Medical Superintendent, SMHS Hospital Srinagar to the Superintendent Central Jail Srinagar yesterday, the High Court was informed. The communication asked the Jail Superintendent to produce the petitioner Peer before the Board on 15th of this December so as to get him examined.

The court directed B A Dar, the additional advocate general (AAG) of J&K, to ensure that the petitioner Peer is produced before the Medical Board on the appointed date. It also asked the AAG that a report be submitted on next date before the bench.

The anti-corruption court in 2018 had convicted Peer and 42 other accused in the 2012 MBBS entrance examination paper scam. The court had sentenced Peer, the prime accused, to 16 years of rigorous imprisonment besides imposing a fine of Rs 1 crore on him for his corrupt practices.

The scam involved the sale of 2012 question papers by Peer through brokers in lieu of money.

The Crime Branch Kashmir in September this year found Peer involved in an alleged financial crime. It produced a charge-sheet against him for illegally shifting government money amounting to Rs 2.73 crore into his personal bank account while holding the trust of an official position.

As per the Crime Branch challan, Peer while being posted as Chairman BOPEE from 2009 to 2012 transferred government money amounting to Rs 2.73 crores into his personal bank account with the object that the same will be utilized for various official activities.

‘(He) with a criminal intent put the said government money to his own use by investing in smart saver accounts, raising cash certificates and liquidation of his personal loan,” it said.
