Court rejects bail to man accused of beating a woman, outraging her modesty

Srinagar: Court of 3rd Additional Judge Srinagar has rejected the bail to a Srinagar man accused of beating a women and outraging her modesty in case under FIR 155/18 under section 354 RPC.

As per the police report, the complainant has filed an application and submitted that she is married to Sameer Ahmad Dar S/o M Yousuf Dar R/o Rajouri Kadal Srinagar for five years and out of the said wedlock, the couple has two children.

She alleged that she was beaten and her modesty was outraged by M Yousuf Dar (husband’s father) and two other outside the court.

Counsel for the accused has submitted that the accused persons have been implicated in a false case; they have not committed any offence nor possess a shade of criminal behaviour on their past and prayed for the absolute bail for the accused.

The APP Bilquees Zargar resisted the application on the grounds that the accused persons are involved in the commission of non bailable offences of heinous nature and cannot claim bail.

“The investigation is at a preliminary stage and in case the accused are released on bail, it will definitely hamper the investigation of the case, the accused will flee from the hands of justice and will not cooperate with the investigation of the case, hence prayed for the rejection of the bail”, Bilquees Zargar added.

After hearing both the counsel for accused and the APP, the said court has rejected the bail application of the accused and directed police concerned to proceed with the matter with due speed but strictly in accordance with law.
