CBK charge-sheets 5 Revenue Dept Officials, private persons for fraud

Srinagar: The Economic Offence Wing of Crime Branch Kashmir has produced charge-sheet against five former Revenue Department Officials and a private individual in the Anti-Corruption court Baramulla, an official press release informed,

It said those charge-sheeted include then Patwari (now retired) Heaven Sheeri Baramulla, Ghulam Haider Mir, son of Munshi Atta Mohammad Mir of Kanthbagh Baramulla; then Naib Tehsildar Baramulla who subsequently retired as ACR Udhampur — Jaswant Singh, son of Ujagar Singh of Shrakhwar Baramulla, presently residing at Kunjawani Bandurakh Gangayal Jammu; then Girdawar Circle Heaven (deceased), Abdul Rashid Khan, son of Hussa-u-din Khan of Gantmulla Bala Baramulla; then Patwari Heaven Sheeri Baramulla (deceased), Mohamed Ashraf Lone, son of Mohamed Yousuf Lone of Budden Saripora Rafiabad; then Tehsildar Baramulla who subsequently retired as ACR Kupwara (now deceased, Firdous Sultan Raina, son of Ghulam Hassan Raina of Usmanabad Kupwara; and a private beneficiary Ghulam Mohamed (also deceased), son of Mohammad Ramzan of Jogiyar Sheeri Baramulla.

The case was registered following a written communication from the then State Vigilance Commission stating that the erstwhile government had notified/acquired land measuring 98.16 Kanals at Narwav Shareenabad Sheeri Baramulla for the Irrigation Department in the year 1968 and compensation thereof was paid to the beneficiaries.

The same land was encroached by local residents with the help of concerned revenue authorities, following which a case was registered (FIR No. 04/2015)  and during investigations it was established that the accused persons (mentioned above) in connivance with each other had prepared false/fabricated revenue documents in the name of various beneficiaries in the year 1982 and thereby illegally transferred the land in the name of beneficiary (mentioned above) by virtue of fake mutation U/S 4&8 of Agrarian Reforms Act.

“The evidence both oral as well as documentary collected has established that accused Revenue officials have by abuse of their official position and in furtherance of a criminal conspiracy hatched between them with private beneficiary managed the illegal mutations in respect of land already notified/acquired and compensated by the government in the year 1968,” the press release said.

It said they have thus prima facie committed offence under section 420, 467, 468, 120-B, 447-A RPC, read with 5(2) PC Act and accordingly charge-sheet of the said case was produced in the court of law for judicial determination.

In a separate press release, it was informed that CBK has also charge-sheeted two individuals in Budgam in the court of Special Mobile Magistrate Budgam for their alleged complicity in preparing fake licences for Fair Price shops. Those charge-sheeted include Aijaz Ahmad Lone, son of Farooq Ahmad Lone of Sumlar Bandipora; and Jamsheed Ahmad Dar, son of Ghulam Rasool Dar of Tilanpora Budgam.
