HC asks CFSL, CBI to complete DNA report in a week
Case of Barzulla youth who parents claim died in Kup encounter
Srinagar July 25: J&K High Court on Wednesday directed the Central Forensic Science Laboratory (CFSL) and Central Bureau of Investigation (CBI) to complete the DNA fingerprinting of a Barzulla (a Srinagar outskirt) man whose son was killed in a gun battle and then buried in the border area of Kupwara.
Justice Tashi Rabastan, who heard a petition seeking exhumation and handing over of the body of Mudasir Ahmed Wani killed in a shootout with Army in June, said “despite lapse of more than 20 days, since DNA sample of the slain youth’s father Gh. Mohammad Bhat of Barzulla has been taken, nothing has happened”.
“In the interest of justice, a week’s time is granted to the respondents to do the needful”, he directed and listed the case for hearing on 1st of August, 2018.
Justice Rabastan referred to a communication CRB/FIR-50/2018-20181 dated 11.07.2018, wherein it has been said that the sample for DNA profiling of the applicant, Gh. Mohammad Bhat S/o Ab. Gani Bhat were collected by the Block Medical Officer, SDH Kralpora, (Kupwara) in presence of the witnesses and forwarded to Director, CFSL, CBI New Delhi, separately for comparison.
Mudasir was buried at the NK Gali area of the Jumgund forests in the Kupwara forests after the shootout. A post-mortem was conducted on his body before being buried in the forest by the forces.
“Even though, on 3rd of this month I along with a delegation comprising several other people of Barzullah locality, visited police station Kralpora, we were shown the photograph of the slain youth”, the petitioner father told the court.
He told the court that he thoroughly looked at the photograph. “How could a father fail in recognizing his own blood”.
He broke down in the court saying “I told them he is Mudasir, my loving son”.
The ageing father told the court that a team of doctors on 4th of July took his blood and DNA sample for an examination by the forensic experts.
He said that at the time his blood and DNA samples were being taken, he was told that the experts from the forensic laboratory will cross-examine the samples with that of the slain youth.
“Once the procedure is completed, a report will be forwarded to district administration, which will exhume the body and if the samples match, the body of your son will be handed over to you”, he told the court of being assured by the officers.
