HC asks FSC to explain laxity in making dept functional
Srinagar, May 30: The High Court on Wednesday directed the presence of State Food Safety Commissioner (FSC) before it to explain his position for not filling up of various posts required in the department to make it functional.
It directed the presence of the Commissioner on 5th of June as the deficiency of the required manpower has given a field-day to food adulterers and profiteers.
The directions were issued by a bench of comprising acting Chief Justice Alok Aradhe and Justice M K Hanjura
The directions followed submissions by amicus curie in the case (a public interest petition) that the government was not filling up various posts which are required in the department.
He also said that there are no regular checks being carried out in the market as a result thereof, thus rendering the constitution of the specially created office of the commissioner a “useless entity”.
The counsel representing the state also admitted that the FSC is not functioning properly as there is lack of accommodation and other infrastructure.
The court has already in the previous hearing directed the government to take all necessary steps for filling up of the post in the department within three weeks.
The court was informed that no process for appointment has taken place so far except advertisement of the required posts by the J&K Subordinate services Recruitment Board.
The court asked the State counsel for presence of FSC and directed that the officer be made personally present before the court on next date of hearing in the PIL, initiated by the court suo-moto.
